Environment Minister's Ordinance of 29 January 2013 on natural risks in mining plants

Environment Minister's Ordinance of 26 June 2013 amending the Ordinance on natural risks in mining plants
The Ordinance lays down the criteria of natural risk determination according to selected criteria. The requirements for the development of the documentation which is the basis for attribution of deposits, beds, mining workings or other mined spaces into particular risk level, category or class. The Ordinance addresses, inter alia, methane, blowout, hydrogen sulphide and radioactive contamination, i.e. potential shale gas drilling risks.
With the Ordinance of 26 June 2013 the Minister of the Environment amended the Ordinance on natural risks in mining plants by postponing to 1 January 2015 the effective date of Environment Minister's Ordinance of 29 January 2013 on natural risks in mining plants. Initially, the Ordinance was to take effect on 1 July 2013.
Before the effective day of the aforementioned Ordinance, the following legal act shall remain in effect:

Council of Ministers' Ordinance of 3 December 2012 on tendering procedures for awarding a concession for exploration or appraisal and for production of hydrocarbons from reservoirs
The Ordinance lays down in detail the tendering procedure for awarding a concession for exploration or appraisal and for production of hydrocarbons from reservoirs, including: appointment and proceeding procedures of tender evaluation committee and the requirements to be met by a tender. The licensing authority prepares specific terms and conditions for each tender procedure.

Environment Minister's Ordinance of 24 April 2012 on detailed requirements applicable to reservoir development programs
The Ordinance defines the contents and the degree of detail for reservoir development programs, including the format of the document (descriptive, graphical and tabular formats).

Environment Minister's Ordinance of 16 February 2012 on mining plant operation plans
The Ordinance lays down the detailed requirements that apply to the contents of operation plans for specific mining plant categories. The requirements for mining plants extracting mineables by drilling are presented in Appendix 3.

Council of Ministers' Ordinance of 10 January 2012 on tender procedures for establishing a mining usufruct
The Ordinance lays down the requirements that apply to tender procedures for establishing a mining usufruct, including: tender announcement procedures and information to be included in the announcement, 2) tender-related requirements, deadline for submission of tenders, tender closure date and time, as well as tender organization and delivery procedures, including tender committee appointment and proceeding procedures.

Environment Minister's Ordinance of 28 December 2011 on underground waste storage facilities

The Ordinance lays down detailed requirements that apply to specific categories of underground waste storage facilities with regard to their location, operation and closure. The approach to, scope and conditions of underground storage facility monitoring are defined. Waste categories that can be non-selectively stored in an underground storage facilities are specified along with criteria and procedures of waste approval for storage in an underground facility.

Environment Minister's Ordinance of 22 December 2011 on geological documentation of mineral deposits

The Ordinance lays down detailed requirements regarding geological documentation of mineral deposits, including those applying to the contents of descriptive, tabular and graphical sections of the documentation. Deposit appraisal categories are specified.

Environment Minister's Ordinance of 22 December 2011 on geological surveying documentation

The Ordinance defines the types of documents that are constituent parts of the geological surveying documentation and detailed requirements regarding preparation, updating and supplementing the geological surveying documentation. Detailed requirements are presented for delivery of land surveying and geological works for the purposes of preparation, updating or supplementing the geological surveying documentation. The Ordinance lays down the procedures and approach to geological surveying documentation handling (transferring and archiving) on winding up a mining plant, including document transfer standard forms.

Environment Minister's Ordinance of 20 December 2011 on use of geological information against a fee

The Ordinance lays down the conditions and procedures for use of geological information against a fee, a standard form of the request for entering into a contract for use of geological information. Geological information value estimation methods and detailed requirements for valuation of geological information are presented.

Environment Minister's Ordinance of 15 December 2011 on detailed requirements regrading other geological documentation

The Ordinance lays down detailed requirements to be met by a geological documentation other than geological documentation of a mineral deposit, hydrogeological and geological engineering documentation, hereinafter called the “documentation”, including standard forms of documents, statements and sheets attached to the documentation.

Environment Minister's Ordinance of 15 December 2011 on the register of mining areas

The Ordinance provides for the approach to the maintenance of mining area registers and identifies data that are to entered to the register, the types of documents that are to be maintained in the register, as well as the deadlines for and procedures for delivery of the entry-required documents. Moreover, deadlines for delivery of mining area maps to the entrepreneur, competent licensing authority and commune head (mayor or city president) are specified.

The Ordinance defines in detail the rates of fees charged by public administration authorities, including local government units, for access to environmental information, rate calculation coefficients, calculation methods, as well as payment deadlines and procedures. The fees are charged for information retrieval, processing, making copies of documents or data and for mailing them.

The Ordinance lay down a list of undertakings that may have a significant effect on the environment. Undertakings are attributed either to undertakings that always may have a significant effect on the environment or to undertakings that potentially may have a significant effect on the environment. Criteria of imposing the obligation to prepare an environmental impact report are specified.

The Ordinance lays down the procedure of waste approval for storage at a waste storage facility of particular type and the criteria of waste approval for dumping at the following three types of storage facilities intended for: a) hazardous wastes, b) neutral wastes, c) wastes other than hazardous and neutral.

The Ordinance lays down the conditions of the R10 waste reuse process, whereby waste is spread over land surface to fertilize or improve the soil. The conditions of such reuse are specified.

The Ordinance lays down 5 standard waste recording forms, including standard waste recording sheet and standard waste transferring sheet.

Environment Minister's Ordinance of 19 December 2008 on the amendment of the Ordinance on the list of waste categories that a waste holder may hand over to natural persons or organizational units other than entrepreneurs, and on permitted methods of recycling thereof
The Ordinance contains a list of 66 waste categories that a waste holder may hand over to natural persons or organizational units other than entrepreneurs. Moreover, the recycling processes and methods for particular waste categories are specified.

Environment Minister's Ordinance of 21 March 2006 on waste recycling and inactivation out of installations and facilities
The Ordinance specifies waste categories and the conditions for recycling thereof using the R14 and R15 processes and the D2 inactivation process.

The Ordinance provides for detailed approach to oil waste handling, including collection, storage and designation for appropriate recovery or inactivation processes. Oil waste characteristics that make the waste attributable to inactivation are specified.

Environment Minister's Ordinance of 13 May 2004 on the conditions for considering waste as non-hazardous
The Ordinance lay down the conditions under which wastes included in the list of hazardous wastes are considered as free of properties or components that make them hazardous waste. Moreover, the approach to ensuring compliance with these conditions is specified.

Economy Minister's Ordinance of 30 October 2002 on waste types that can be stored on a non-selective basis
The Ordinance enumerates specific waste types that can be stored on a non-selective basis and requirements which must be satisfied in order for that waste management method to be permitted.

Environment Minister's Ordinance of 11 December 2001 on waste types and quantities which are exempted from the obligation to keep waste records and on the category of small and medium enterprises which are permitted to maintain simplified waste records
The Ordinance specifies the types and quantities of waste produced annually by a waste holder that are exempted from the obligation to keep waste records. The list is attached as appendix to the Ordinance. Conditions that are to be met by an enterprise in order to be eligible for simplified waste records are specified.

Environment Minister's Ordinance of 27 September 2001 on the Catalogue of Wastes
The Ordinance provides for a catalogue of wastes with a list of hazardous wastes and waste categorization methodology. Depending on their origin, wastes fall into 20 groups which are divided into sub-groups and types. Each waste type is assigned a six-digit code.
